I have been in a lawsuit with Erie insurance exchange going on 6 hrs now. I beat them once and they appealed.

They even told my attorney that they rather give the money to their attorney than give it to me. I've got news for them and it's the same. I'd rather give it to their attorney than let them off the hook. That got made when I turned them in to the TN.

insurance commission. It might sound like a bad business decision but it's not about the money to me. A third party will call the final decision; not Erie, their attorney, their mediator, nor their expert witness. I've actually enjoyed the fight.

They throw everything on the wall to see what sticks. It's been comical. Erie is full of you know what and they have a great fighter. In fact, even if I win again, I might appeal it again just to make them happy about giving their money to their attorney.

When i do win and I will, I think I will get more insurance through them just because they are so easy to beat in court. Reason being, they hire idiots for expert opinions and are *** and unprepared when they show up to court. I'm going to match the expense Penney to Penney until a verdict is made. Luckily I have the money and I enjoy the challenge.

I truly don't care if I have a net loss over all cause I get my satisfaction out of being a thorn in their ***. I will never go away, no matter the cost. They will spend the money one way or another. Thanks Erie, I'm enjoying the fight.

I do have to say for those who don't want to fight over claims then buy any insurance you may have with someone other than Erie.

I'd be more interested the details of the claim rather than a long tale about the fight.

Yes. Just type in the name of the company that you are considering.

When I did, too late, I found Erie denied a $100,000 claim, and ended up paying 19 million. There is also a list of insurance companies under " Bad Faith". Definitely check it out, before you give these crooks your money, cause once you do, it becomes theirs, and they do not honor their comittment as required.

They need Fraud cases brought against them. People unite, Class action Law suit.

To Whom It May Concern,

I am praying that this concerns someone! On April the fifth of this year a large tree fell on our home during a storm. As instructed we contacted our Insurance Company, which we had with Erie Insurance with Jeff Demo from the Charlotte, NC office. Later in the day Dave Mendenhall a adjuster from the Greensboro, NC office came by. There was nothing he could do because the damage was over twenty five thousand dollars, he would have to call a major damage adjuster . The same day Gregory Brett Chapel arrived and immediately wrote us a check for five thousand dollars. We were informed by him we needed to locate a company to remove our remaining belongs from the house. He recommended Paul Davis a company from Kernersville, NC, which we called and retained them the job. Our next step according to Mr. Chappell was to find a tree company to remove the tree from the house. Arriving fifteen minutes after Mr. Chappell was a representative

from รขโ‚ฌล“ Fraley Tree Companyรขโ‚ฌย. Mr. Chappell stood off with themselves for forty five minutes or so talking. Feeling the urgency coming from Mr. Chappell we decided to let Fraley have the job. Mr. Chappell stated in front of four witness, which are will to give sworn statement, he said, รขโ‚ฌล“the insurance will take care of the tree รขโ‚ฌล“would cover the cost of the tree, In fact he told the represenitive from Fraley to sent him the bill directly, this also in front of witnesses. Five or six weeks went by and then Mr. Chappell called my wife and wanted to meet her at her office and settle. He didnรขโ‚ฌโ„ขt ask that I be there. For six weeks we were without a copy of our policy, as ours were destroyed in the disaster. In the mean time we had contacted the North Carolina Insurance Commission because we were so confused and never been through this type trauma before wanted to know where we stood on a certain issue. When this happened Mr., Chappellรขโ‚ฌโ„ขs attitude changed toward me, I guess that is why he only wanted to meet with my wife. When Mr. Chappell enter my wife office he had a look of shock on his face. Mr. Chappell had two checkรขโ‚ฌโ„ขs with him. One made out to two parties, Mr. Farleyรขโ‚ฌโ„ขs Tree Company and my wife and myself in the amount of eight thousand and five hundred dollar. When I question him about the statement he had on at least four occasion, รขโ‚ฌล“ The insurance would take care of that, send the bill directly to himรขโ‚ฌย. He stated he was not allowed to do that, (strange). I ask him where the money was coming from he stated, รขโ‚ฌล“ from your structureรขโ‚ฌย. The caught me by surprise because I had not been informed prior to this. We had three or four riders numbers on our policy so I ask him to please explain the to me and he stated, รขโ‚ฌล“I can not because he did not know what the numbers stood forรขโ‚ฌย and yet he was wanting us to settle the claim By this time I was feeling like something was going on, my trust level was beginning to fate, but little did I know the largest surprises were yet to come. The other check for the amount, after eight thousand and five hundred was deducted for the tree. Was one hundred and eighteen thousand dollars. I questioned why the amount was so low, seeing our house was insured for one hundred fifty three thousand plus replacement cost. That is when the next surprise came. The replacement cost was held back until we finished the house. We were to keep receipts until we had spend the one hundred and fifty three dollars, then the replacement cost would be released. I question why we had not discussed this before and I was told I had a policy, I should have read it. One thing you must remember we are not insurance adjusters, we do not understand the term logy . When I looked at the policy and had to keep turning back to A to see what B meant I was totally confused. Concerning the replacement cost he stated, รขโ‚ฌล“ he would pay it to us in thirds, first third when we started, second when we were half through and the last third when we finished. I questioned him about this because he was acting like a mortgage company. He stated, รขโ‚ฌล“ I talked to the mortgage company and told them it would be much easier if they let him handle that part. I shared with Mr., Chappell on several occasions that I was planning to pay the house off and nothing was ever said, We left the meeting and proceed looking for contractor and the work started on the house. We used the monies from what he gave us and the monies from the two other structure on our property, knowing we would be getting the replacement monies later. We paid the house off and paid the contractors as they went. I sent Mr. Chappell the receipts as we went but I began to notice that the only monies coming back was for content. I called Mr. Chappell and he informed me for the first time during these proceeding, even though I told him what my plan were, that the money for paying the house off did not go toward the one hundred and fifty five thousand. In my opinion he withheld this decision, for whatever reason, until this time. This through us into hysterias! He stated, รขโ‚ฌล“when you show me receipts for one hundred and fifty three dollars for work done on the house I will release the replacement costรขโ‚ฌย. All the receipts we had sent in paying the contractors were held. I ask Mr. Chappell what happens to the money if we cannot produce receipts in that amount.( most of the rebuilding was done by a national organization .They give labor free, the home owner pays for the material) รขโ‚ฌล“We keep itรขโ‚ฌย. Twenty seven thousand and some odd cents lost because Mr. Chappell held back information that may have caused us to make a different discussion. I talked to Mr. Chappell for the last time and tried to make some sense out of this whole matter Mr. Chappell denied most of everything I have said here. He claimed to have document everything, which he did but it was only after I called him on the matter, my phone record will show that ever time I called him ,a day or two latter we would receive a letter documenting whatever we discussed. In my opinion Mr. Chappell was upset with me for calling the North Carolina Insurance Commission I believe that he and the tree people were working together because he went from send me the bill, we pay that ,to a two party check. Even the tree people told us that we didnรขโ‚ฌโ„ขt hire them, Mr. Chappell did. When we ask them to put it in writing, they backed off. We never signed a contract with them. Mr. Chappell did recommend Paul Davis Company to remove and store our property. We had problem with them denying to process antiques from the house.

In my opinion Mr., Chappell chases people in a state of shock over losing their house and most of the valuables and tells them what ever he wants to and is never held accountable for those words

Why is it I paid the premiums all these years to make sure if anything like this would occur I would have plenty to take care of it.

Who would have ever thought that at 63 years old I would be setting with my house ร‚ยพ rebuild, broke, and losing twenty seven thousand dollars in the process. But according to Mr. Chappell I am a lair and made this whole wild story.

Where is justice?

I am have a hard time now getting the rest of the money for recovery lost!
